Question on Rolo's status

We've had a lot of discussion about what might happen to Rolo on deadline day, but apart from the cut and dry scenarios (waiver or terminated), I wonder if there are other solutions in play that we're not aware of?

For example, my company "reclassified" a good percentage of our team so that we appear to have less than 100 employees. Could WSU put him on paid leave through the season? Could Rolo appeal the decision and remain coach until the case is heard before the State Supreme Court? Yes, I believe it could go that far if his waiver is denied. COVID cases are beginning to drop dramatically, to the point where health agencies are starting to hint that it may be behind us.

I mean, Rolo has pretty much backed himself into a corner on this. It's going to be very difficult for him to find another P5/G5 job, so you'd better believe that he'll do everything he can to get his full buyout. If WSU decides to move away from him, as much as it'll hurt financially, I think we'd be wise to pay his buyout and put this behind us as quickly as we can.

Just an FYI on the 100 employee threshold for the OSHA mandate if you’re in Washington. Word is WISHA/DOSH will be adding restrictions. Fewer then 100 and probably no testing option.

I think the cake is baked. Would have loved to see what he could do with four years. But he is going against three people. His Prez and AD. Schultz believes in vaccinations and has I believe 98% of the student population vaccinated. As he said in the article he and rolo needed to be on same page as leaders. They are not.

Then throw in the Inslee Factor. What does he believe his mandate is ? Get covid under control so businesses can thrive in the area. He cannot allow his highest paid employee be the exception. Get special treatment . He has to make an example of Rolo if he wants people to take serious the mandate.

They may “suspend” until year end. He maybe be considered different because he has a long term contract.

What is a shame is Dickert and staff are likely to lose their jobs at the end of the year. For most it means starting over .

But it isn’t just rolo who isnt vaxed. It is our qb coach and several other coaches. It will be interesting to see how they bridge the gap for offensive coaches because I would guess they will be three short on that side of the ball.

Patrol I think it was you who said there. Pike be cultural issues at play as to why they aren’t vaxed. I am curious what they may be. Stutzmans brother lost his job at navy .There are two family members that are in the same profession that have lost their jobs for the same reason.

No. If he’s on paid leave, he’s still an employee and the mandate applies. He’ll be on unpaid leave starting October 19. Also, if he’s on paid leave then he hasn’t been “damaged” and has no standing to sue. The university could easily argue at this point that reputational damage is due to his own actions/statements, not the university’s. He’ll have to lose money and position to gain standing. Oh, and he’ll lose in the Supreme Court.

I agree we’d be better off just getting it behind us though…and the university loves to settle.

Not sure about the employee threshold, but under current conditions there’s not going to be a testing option in Washington. Inslee’s pretty well dug in on denying that…although his “logic” is severely flawed.

There are multiple lawsuits in process, at least a couple of them are demanding a testing alternative. I’m hoping one of those makes it through and forces the option. That’s preferable to the fight over exemptions…especially since the governor structured those to put the burden on the employer.
 
I’m talking about the federal osha mandate that applies to all private employers with more then 100 employees Biden is pushing, which will have a test option. Washington will likely adopt it with more restrictions then OSHA with testing not part of the formula for compliance based on what we’ve heard in my industry.

I know, I’m hearing the same as you. But right now even if L&I wants to put in a testing option, Inslee isn’t having it.

I haven’t heard a timeline on the OSHA emergency rule (and they have a poor track record of enforceability) so I haven’t dug into it too deeply, but I’m expecting that in Washington it’ll just codify what’s already in the governor’s proclamations.

By the way, since masks have been the answer then why aren't they acceptable instead of the jab?

I think the better question is why many states - and now even events in Washington. - can have a testing alternative, but employment can't. Listening to Inside fumble around an answer for that is painful. Even more than listening to him speak normally. No idea how someone who routinely sounds as clueless as he does ever got elected to anything.

To put it bluntly, nobody with any talent wants to work & live in Olympia.

He was kept in check his first 6 years while Frank Chopp was house speaker.

Yes. Like so many things related to this covid situation there is numerous inconsistencies and baffling policies that make no sense.

But people like Ed and company don't think. They just blindly follow their government and media masters no matter what.

It truly is pathetic and destructive to our country. But perhaps that is the point?
