Basically Dan Evans was completely biased towards the UW (student and later regent) and Evergreen (creator and later school president when departed governor's mansion) and let every other higher ed school in the state of Washington take a hike.

Barber case established legal precedent. It is one thing to deny someone due process provided by established law, which is violating the law, it is another when a court after the fact holds that established law does not provide adequate due process. The later occurred in Barber's case, according to the court of appeals. Those subject to school expulsion/discipline are now afforded greater due process protections than they had been previously afforded, state wide. That is a good thing. But lets not forget the fact that Whitman County, not WSU, charged Barber with felony assault after he blind-side, cold cocked a guy who happened to be half his size. Ultimately, the county prosecutor believed, but couldn't prove beyond a reasonable doubt, that Barber had the requisite mens rea, i.e. guilty mind or intent. He was the perpetrator. That's on video and Barber never argued, at his trial, that it wasn't him. Instead, he successfully argued that he was panicked and acted out of fear during a melee.
It was never a situation of expelling the wrong guy man. Barber could have killed a fellow student. It appears to come down to whether he was a basically a callous punk or someone who simply panicked and exercised very poor judgment, as a result. Barber had a ton of support, but the discipline board at WSU is hardly a Texas jury. Who knows?
Based on circumstance, I must assume there isn't substantial evidence that WSU intentionally destroyed exculpatory evidence. Had they, that is the surest example of violating due process, legally, and would form the strongest basis for a civil suit, i.e. intentional wrong doing, if not criminal. Had they, Barber would likely have sued us, wouldn't you? Was there ever a monetary settlement? Anyone?
I only wish Robert Barber had half the talent of his kindred spirit, Keith Millard, who plead guilty to a lesser charge under similar circumstances. Millard also faced expulsion, but he and Walden took a different approach, both begged for mercy, and pulled on liberal heart strings regarding Millard's very difficult childhood.

Sort of. Evergreen had - for a long time - a day when minorities willingly absented themselves from campus. One year they decided to change it up and “ask” all the white people to absent themselves. Two professors objected because there’s a big difference between choosing to not show up yourself and telling someone else not to.
