Anyone else fully expecting to lose and or have a resolution that muddies the water and leaves us in a prolonged limbo? This year has been pretty trying for the program and I am jaded enough that I can see tomorrow being a day that winds up poorly just when we thought it wouldn’t.

I have a feeling we'll get a ruling and it'll immediately go to appeal, where it will then be moved to a west side court where the filing party will have a decided advantage.

Yes, I pretty much got that from Wilner, but I think he's right.
 
I actually expect a ruling in our favor only for it to immediately be appealed to the state supreme court
I haven't read everything, but this is my opinion too. Only the appeal will be to Division III of the Court of Appeals, and the petition for review to the Washington Supreme Court will be denied. So, in 18-24 months we'll have resolution. uw and the rest of the members have time on their side; WSU and OSU do not.

I think the writing in the bylaws is pretty clear, and don't really see any way to interpret them that doesn't favor WSU/OSU.

But, I'm also not convinced that it's really up to a court to decide. I could see a judge looking at it and sending everyone back to figure it out for themselves...which then gives the 10 an advantage in their mediation.

The initial issue of who gets to vote, and who doesn't, has to be decided by the court. That will be the issue before the court tomorrow.

The distribution of the assets is something that the voting members will later decide amongst themselves.

Well, if that's the case, it should be a slam-dunk. The bylaws are crystal clear on that point, and precedent is on our side.

And, the claims from the 10 that they'll be damaged and unable to pay costs of being part of the conference are completely incorrect. The bylaws clearly state that their costs will continue to be reimbursed - the only thing they (maybe) forfeit are their media payouts.

Why would they appeal it right away. I think they’ll wait until the last minute and drag this out as long as possible.
